1. Binding Agreement
By accessing or purchasing from this Site, you enter into a legally binding agreement governed by Alberta and Canadian law.
If you do not agree, you must discontinue use immediately.
2. All Sales Final – No Returns
ALL SALES ARE FINAL.
We do not provide refunds, returns, or exchanges except where required by law.
Exceptions apply only if:
- The product is materially defective
- The product was damaged in transit
Claims must be made within 7 days of delivery with photographic evidence.
Incorrect size selection does not qualify for refund or exchange.
3. Assumption of Risk
You acknowledge that:
- Apparel sizing and material feel are subjective
- Color variation may occur
- Printed merchandise may contain minor variations
You assume full responsibility for product selection.
4. Chargeback & Fraud Protection
By completing a purchase, you agree:
- Not to initiate fraudulent chargebacks
- To contact us first to resolve disputes
Fraudulent disputes may result in:
- Account blacklisting
- Collection action
- Legal enforcement
- Reporting to fraud monitoring databases
5. Limitation of Liability (Expanded Protection)
To the maximum extent permitted by law:
T.A.I.L. shall not be liable for:
- Indirect, incidental, punitive, or consequential damages
- Emotional distress
- Reputational harm
- Lost profits
- Business interruption
- Third-party claims
Total liability shall never exceed the purchase price of the product in dispute.
6. Indemnification
You agree to indemnify and hold harmless T.A.I.L. from any claims, damages, legal fees, or losses arising from:
- Misuse of products
- Violation of these Terms
- Infringement of intellectual property
- Fraudulent payment activity
7. Intellectual Property Enforcement
All designs, branding, artwork, and content are protected under Canadian and international copyright laws.
Unauthorized reproduction, resale, or commercial use may result in:
- Immediate legal action
- Injunctive relief
- Monetary damages
8. Website Availability
We do not guarantee uninterrupted access.
We may suspend, modify, or terminate the Site at any time without notice.
9. Governing Law & Jurisdiction
All disputes shall be governed exclusively by:
- The laws of Alberta
- The federal laws of Canada
Any legal action must be brought in Alberta courts.
10. Severability
If any provision is deemed unenforceable, the remaining provisions remain valid.
